Welcome to Appify. This website/mobile application and the services provided through the Website/app is operated by Appify (Appifyretail Private Limited). Appify (“Appify”,“Us“, “We“, or “Our“) website/mobile application (hereinafter collectively referred to as the “Platform” or “[owner of the site/platform]” which also includes its affiliates), is the author and publisher of the internet resource website and application.

Our Privacy Policy explains how We collect, use, disclose, protect and share your information when you visit Our Platform, or use Our services. This policy also explains the choices that you can make about the way that We use your information. This Privacy Policy is incorporated into and forms an integral part of Our Terms and Conditions. Capitalized terms have the same meaning as ascribed in Our Terms and Conditions.

We ask you to read this Privacy Policy carefully and take the time to know Our practices.

By registering your details at Our Platform, you are authorizing Us to contact you via email or phone call or SMS and offer you Our services, imparting Our services related information, any promotional activities or any offers running on the Platform & also offers offered by the associated third parties, for which reasons, personally identifiable information may be collected.

Controller” shall have the same meaning as provided in Article 4 of European Union General Data Protection Regulation (“GDPR”)).

Users” shall mean the consumer of the Appify’s Platform.

  • User Information: In order to provide you with the Services, We must collect personal information relating to an identified or identifiable person (“Personal Information”). Here are the types of Personal Information We collect:
    • Information you provide to Us: When you register for Our Services or access Our Platform or contact us directly by any communication channel (Phone number/e-mails, etc.), you may provide us personal Information such as name, e-mail address, phone number, payment information, information you include in your communications with Us and Personal Information contained in scanned identification documents provided to Us.

For example, We may collect email addresses, or otherwise collect and manage contacts of Users of Users via the user’s website/application and store such information with Us, on the User’s behalf.
    • For such purposes, Appify serves and shall be considered as a “Controller” and are responsible for complying with all laws and regulations that may apply to the collection and control of such Users of Users Information, including all privacy and data protection laws of all relevant jurisdiction.
  • We also collect information that is provided to Us by the candidates who apply for the job to any position either through the Platform or by email contact@appi-fy.ai.
  • We use your Personal Information for the following purposes:
    • Our use of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you (e.g. to provide you with a website builder, to provide you with our customer assistance and technical support);
    • Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that We have; or
    • Our use of your Personal Information is necessary to support legitimate interests and business purposes (for example, to maintain and improve our Services and the effectiveness of Appify by identifying technical issues), provided it is conducted in a way that is proportionate and that respects your privacy rights. We use the Personal Information we collect about you to provide Our Services and make them better and safer. We also collect and use Personal Information in order to contact Users and to comply with the laws applicable to Us.

  • Whenever you visit Our Platform, We may collect information that your browser sends or when you access the Platform by or through a mobile device or computer system (“Usage Data“). Unless a different time frame applies as a result of business need or specific legal, regulatory or contractual requirements, where we retain personal data in accordance with these purposes, we retain such personal data as per policy of the Appify.
  • Categories: The Platform collects information that is stored by your browser on your computer’s hard drive i.e. through cookies. It further automatically log generic information about the user’s computer connection to the Internet i.e. Session Data. The Platform may store temporary or permanent ‘Cookies’ on the user’s computer. Below is a summary of the categories of cookies collected on our Platform, and how your consent may impact your experience of certain features as you navigate those websites:
    1. Strictly necessary cookies: strictly necessary Cookies are essential in order to enable users to move around the Platform and use its features, such as accessing secure areas of the Platform. These cookies must be enabled or the site will not function, and cannot be blocked.
    2. Performance Cookies: Performance Cookies are Cookies used to gather data to enhance the performance of the Platform.

  • In connection with a change in corporate control: In addition, should Appify or any of its affiliates undergo any change in control, including by means of merger, acquisition or purchase of substantially all of its assets, your Personal Information may be shared with the parties involved in such event.
  • Upon Your Further Direction: The Appify Services enable you, through different techniques, to engage and procure various third-party services, products and tools for enhancing your web or mobile sites, including, without limitation, applications and widgets offered to you by third parties through the Appify Website (including Appify App), e-commerce payment providers, third-party designers who may assist you with your website, etc. (collectively, “Third Party Services”). If you choose to engage with such Third-Party Services, they may have access to and process Personal Information of your Users-of-Users collected through your web or mobile sites.

 

  1. CHOICES
    • In general, you are not required to submit any personal information to the Website, but we will require you to provide certain personal information in order to receive additional information about our services. We will also ask for your permission for certain use of \your information and you can agree to or decline those uses. If you opt-in for particular services or communications you will be able to unsubscribe at any time by following the instructions included in each communication. THE USER HEREBY REPRESENTS AND CONFIRMS THAT THE INFORMATION PROVIDED TO THE PLATFORM IS AUTHENTIC, CORRECT, CURRENT AND UPDATED. THE PLATFORM AND ITS ENTITIES SHALL NOT BE RESPONSIBLE FOR THE AUTHENTICITY OF THE INFORMATION THAT THE USER MAY PROVIDE. THE USER SHALL BE PERSONALLY LIABLE AND INDEMNIFY THE PLATFORM FOR THE BREACH OF ANY PROVISION.

  • Security Measures:The security of the Personal Information supplied by the User is very important to the Platform and the Platform for the purpose of securing the information takes various measures inclusive of taking reasonable steps such as physical and electronic security measures to guard against the unauthorized access to the information. The personal information of a user is collected on a secured server. The payment details are entered on the Payment Gateway’s or Bank’s page on a secured SSL. The data is transferred between Bank’s page and payment gateways in an encrypted manner. However please note that no data transmission can be guaranteed to be completely secure. Hence the user is advised to take precaution and care against any sharing of the details submitted on the website included the log-in details as generated after registration. The website is not responsible for the security or confidentiality of communications the user may send through the internet using email messages, etc.

  • Direct marketing – To conduct and analyze our marketing activities. To deliver timely market insights and speciality knowledge including tailor-made online experience we believe is welcomed by our business clients, subscribers and individuals who have interacted with us.
  • Monitor our IT systems – Prevent fraud or criminal activity and protect our IT systems.
  • Corporate responsibility – Comply with our corporate and corporate social responsibility commitments.

  • Service and billing messages: We may also contact you with important information regarding our Services, or your use thereof. For example, we may send you a notice (through any of the means available to us) if a certain Service is temporarily suspended for maintenance; reply to your support ticket or e-mail; send you reminders or warnings regarding upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints regarding your User Website; or notify you of material changes in Our Services. It is important that you are always able to receive such messages. For this reason, you are unable to opt-out of receiving such Service and Billing Messages unless you are no longer an Appify User (which can be done by deactivating your account).

 

  1. YOUR RIGHTS IN RELATION TO YOUR “PERSONAL INFORMATION”
    • Access – Appify believes that it is imperative that all Appify users have control over their Personal Information. Therefore, you may have the right to request access to, receive a copy of, update, amend or delete, restrict, or object to certain uses of your Personal Information (for example, for direct marketing purposes). Further, when We rely on your consent for the processing of your Personal Information (for instance, for direct marketing) you can withdraw your consent at any time, and such withdrawal will take effect from thereon
    • If you are Appify user, you can access and correct a lot of your Personal Information directly through your account. You can also exercise your rights by sending your request to [email id] or reaching out to our customer care department. When we receive your right request, we may take steps to verify your identity before complying with the request to protect your privacy and security.

Before fulfilling your request, We may ask you for additional information in order to confirm your identity and for security purposes. We reserve the right to charge a fee where permitted by law (e.g. if your request is unfounded or excessive).

  • Right to Withdraw Consent – You can withdraw your consent that you have previously given to one or more specified purposes to process your personal data. This will not affect the lawfulness of any processing carried out before you withdraw your consent. It may mean we are not able to provide certain products or services to you and we will advise you if this is the case. If you would like to exercise your Data Subject Rights, you can email contact@appi-fy.ai. We may need to request specific information from you to help us confirm your identity and ensure your right to access the information or to exercise any of your other rights. This helps us to ensure that personal data is not disclosed to any person who has no right to receive it. No fee is required to make a request unless your request is clearly unfounded or excessive. Depending on the circumstances, we may be unable to comply with your request based on other lawful grounds.

 

  1. RETENTION OF DATA
    • We may retain your Personal Information as well as your Users of User’s Personal Information for as long as your User Account is active and as long as We may consider it necessary or as otherwise needed to provide you with Our services.
    • We may continue to retain your Personal Information after your account is deactivated and/or cease to take Our services, as reasonably necessary to comply with Our legal obligations, to resolve disputes regarding Our users or their Users of Users, prevent fraud and abuse, enforce Our agreements and/or protect Our interests.
    • To determine the appropriate retention period for Personal Information, We consider the amount, nature, and sensitivity of such information, the potential risk of harm from unauthorized use or disclosure of such data, the purposes for which We process it, and the applicable legal requirements.
    • Unless a different time frame applies as a result of business need or specific legal, regulatory or contractual requirements, where we retain personal data in accordance with these purposes, we retain such personal data as per policy of Appify.

 

  1. ADDITIONAL INFORMATION FOR CALIFORNIA RESIDENTS
    • If you are a California resident using the Services, the California Consumer Privacy Act (“CCPA”) grants you the right to request access to and deletion of the Personal Information Appify collects about you, as well as to request that We disclose how We collect, use, and share your Personal Information.
    • California residents also have a right to opt-out of the sale of their Personal Information by a business and a right not to be discriminated against for exercising any of their rights under the CCPA.
    • No sale of Personal Information. Appify does NOT sell (as such term is defined in the CCPA) your Personal Information or your customers’ (Users-of-Users) Personal Information to third parties.
    • Right to Know: If you want to exercise your right to know or receive a copy or access the Personal Information that you have stored with Us, you can submit a request to access your Personal Information by email to contact@appi-fy.ai.
    • Right to Deletion: If you want to exercise your right to request deletion of any of your Personal Information that you have stored with Us, you can submit a request to delete all your Personal Information (including information accessible via your User account and any other Personal Information We hold about you) by email to contact@appi-fy.ai.

Once We receive and verify your consumer request, We will delete your Personal Information from Our records unless an exception applies. We will make reasonable efforts to honor your request promptly and consistent with the requirements under applicable law.

Please note that permanently deleting your Appify account erases all of your Personal Information from Appify’s databases. After completing this process, you can no longer use any of your Appify Services, your account, and all its data will be removed permanently, and Appify will not be able to restore your account or retrieve your data in the future. Additionally, if you contact our support channels in the future, the system will not recognize your account, and support agents will not be able to locate the deleted account.

If you cannot access your Appify account or if you wish to exercise your CCPA rights through an authorized agent operating on your behalf, you, or your authorized agent (as applicable) may send a request to contact@appi-fy.ai or reach out to Our customer care department, including by requesting a callback from a customer care expert. To process your request, in order to protect Users’ accounts and Personal Information, We may ask you or your authorized agent for the verifying information detailed above, which may vary according to the circumstances of your request. Authorized agents will also need to provide Appify with a copy of the consumer’s signed authorization designating them as their agent.

  • The rights described in this section may also apply to other U.S. States’ residents, according to applicable laws and regulations.

 

  1. UPDATES AND INTERPRETATIONS
    • We may update this Privacy Policy as required by applicable law, and to reflect changes to Our Personal Information collection, usage and storage practices. If We make any changes that we deem as “material” (in our sole good faith discretion), We encourage you to periodically review this page for the latest Information on our privacy practices. Unless stated otherwise, Our most current Privacy Policy applies to all information that We have about you and your Users-of-Users, with respect to Our Platform and Our services. Any change made to this Privacy Policy is effective when it is posted on this page.

    • We honour users’ privacy and employ the best practice to secure the user’s personal details, such as birth details, address, etc., and also financial details such as credit card or debit card transaction details. We use the best encryption methodologies to ensure secure transactions from our side and thus encourage our Users to use their credit/debit cards / UPI IDs on Appify with full confidence. By doing so, we strive for the safety and security of our users, thus making their experience with Appify absolutely safe and secure. Despite our best efforts, however, security cannot be absolutely guaranteed against all threats. To the best of our ability, access to your personal information is limited to those who have a need to know. Those individuals who have access to the data are required to maintain the confidentiality of such information.
    • We also make reasonable efforts to retain personal information only for so long: (1) as the information is necessary to comply with an individual’s request, (2) as necessary to comply with legal, regulatory, internal business or policy requirements, or (3) until that person asks that the information be deleted. The period for which data is retained will depend on the specific nature and circumstances under which the information was collected.
    • Links to the third-party sites: Please note that our Platform may typically contain links to other sites and are not governed by this privacy policy but by other privacy policy that often differ somewhat. We encourage you to review the privacy policy of each site visited before disclosing any personal information.

Due to the nature of electronic communication processes, the Platform does not guarantee or warrant the Platform will be uninterrupted, without delay, error-free, omission-free, or free of viruses. In no event shall Appify, or any of their respective partners, principals, agents or employees, be liable for any direct, indirect, incidental, special, exemplary, punitive, consequential or other damages (including but not limited to, liability for loss of use, data or profits), without regard to the form of any action, including but not limited to, contract, negligence or other tortious actions, arising out of or in connection with the Site, any content on or accessed by use of the Platform, or any copying, display or other use.
  • Appify reserves the right to change or modify, from time to time, any provision related to the Service(s) or these Policy, at its sole discretion. Any such change(s) shall be effective immediately upon the posting of revised Policy and may or may not be separately notified via email. Your continued use of the Platform following the posting of the change means that you accept and agree to the changes. If you do not agree with any such change, your sole and exclusive remedy is to terminate your use of the Application.
